Please read these Terms carefully before placing an order. By placing an order, you agree to these Terms together with our Privacy Policy, Refund & Returns Policy and any product-specific, delivery or promotional information made available before checkout. 2. Using this website
2.1. You may use this website to browse products, read care and buying information, create an account, place orders, contact West Cork Reptiles and manage your customer information.
2.2. You must not misuse the website, attempt to gain unauthorised access, interfere with its operation, submit false or fraudulent information, upload harmful material, scrape the website in a way that interferes with its operation, or use the website for unlawful or fraudulent purposes.
2.3. We may suspend or restrict access to the website where reasonably necessary for security, maintenance, technical reasons, suspected fraud, legal compliance or the protection of animals and customers.
3. Customer responsibilities
3.1. When placing an order, you must provide accurate contact, billing and delivery information, including an Eircode where applicable, and any information reasonably required to process the order safely and lawfully.
3.2. For live animal purchases, you are responsible for ensuring that an appropriate enclosure and care setup is ready before delivery or collection. This may include suitable heating, lighting, thermostat control, humidity, substrate, hides, water, food and other species-specific requirements.
3.3. You should not order a live animal unless you are able to receive and care for it properly. We may ask reasonable questions about the proposed setup and may refuse, delay or cancel a sale where there is a genuine animal-welfare, legal, transport or biosecurity concern. If an order is lawfully cancelled after payment has been taken, the relevant amount will be refunded.
3.4. West Cork Reptiles will not knowingly sell or supply an animal contrary to applicable age restrictions or animal-welfare law. We may request reasonable confirmation of age or other information where required to comply with the law.
3.5. Information provided on this website is general husbandry guidance and is not a substitute for veterinary advice. If an animal is unwell, injured or in distress, contact a suitably qualified veterinary professional without delay.
4. Product information and availability
4.1. We take reasonable care to keep product descriptions, photographs, prices, stock information, species information and delivery information accurate and up to date. Availability may change, particularly for individual animals, frozen food and live food.
4.2. Photographs of live animals are intended to represent the animal as accurately as reasonably possible. Appearance may vary because of lighting, camera settings, growth, age, shedding cycle and natural variation.
4.3. Where information such as species, morph, sex, age, weight or feeding status is provided, it is given in good faith based on the information reasonably available to us at the time.
4.4. Advertisements for pet animals will include the information required by applicable Irish law. This includes the seller or supplier registration number where required, the age of the animal and the country of origin, together with any other information legally required for the particular animal.
4.5. If an important detail about a live animal changes before handover, we will contact you where reasonably necessary. If a product or animal becomes unavailable after an order is placed, we may offer a suitable alternative, agree to wait for availability, remove the unavailable item or cancel the affected part of the order and refund the amount paid for it. We will not substitute one live animal for another without your agreement.
5. Orders and contract formation
5.1. When you submit an order, you are making an offer to purchase the selected products under these Terms. An automatic order acknowledgement or payment receipt confirms that we have received your order or payment; it does not necessarily mean that the order has been accepted.
5.2. A contract is formed when West Cork Reptiles expressly confirms acceptance of the order, confirms dispatch or collection, confirms the livestock delivery arrangement, or otherwise clearly confirms that the order has been accepted, whichever occurs first.
5.3. Before a contract is formed, we may refuse an order where there is a lawful and reasonable basis to do so, including where:
- the product or animal is unavailable;
- payment has not been received or authorised;
- there is an obvious pricing, stock or product-information error;
- delivery is unavailable or legally restricted for the requested location;
- we cannot safely or lawfully supply or transport a live animal, frozen food or live food;
- the customer does not provide information reasonably required to complete the order;
- there is suspected fraud, misuse of the website or misuse of a promotion; or
- proceeding with the order would create a genuine animal-welfare or legal-compliance concern.
5.4. If we refuse or cancel an order before acceptance after payment has already been taken, we will refund the relevant amount using the original payment method unless another lawful method is expressly agreed.
5.5. Nothing in this section permits us to cancel or alter a binding contract contrary to your statutory consumer rights.
6. Prices and payments
6.1. Prices are shown in euro unless clearly stated otherwise. The total price payable, including any applicable taxes and mandatory charges, will be shown before you place the order.
6.2. Delivery, livestock delivery and other additional charges will be shown before checkout where they can reasonably be calculated in advance. Where an additional charge cannot reasonably be calculated in advance, we will explain that an additional charge may be payable and, where required, how it will be calculated before you become bound by it.
6.3. Available payment methods may include card payment, Stripe, bank transfer, PayPal, cash on collection or other methods shown at checkout. Available methods may vary depending on product type, order value and delivery method.
6.4. For live animal orders, full payment or another expressly agreed payment arrangement may be required before delivery or collection. Any deposit conditions will be made clear before payment is taken.
6.5. If we identify an obvious pricing or stock error before accepting an order, we may reject the order and refund any payment already received, or contact you and ask whether you wish to proceed on the correct terms.
6.6. Any optional additional payment must be expressly chosen by you. We will not rely on a pre-selected option to obtain consent to an additional charge.
7. Live animal sales and animal welfare
7.1. Live animals are handled differently from standard products. Animal welfare is a priority throughout the sale, preparation, transport and handover process.
7.2. We will not knowingly sell, supply or transport an animal where doing so would breach applicable animal-welfare legislation or other legal requirements.
7.3. Before ordering a live animal, you should understand the species' husbandry needs and have a suitable enclosure ready. West Cork Reptiles may contact you after an order to discuss the animal, customer readiness, delivery or collection and a safe handover arrangement.
7.4. Live animals are not sent through DPD, An Post or an ordinary parcel courier. They are delivered using an appropriate livestock transport arrangement or collected by appointment where agreed.
7.5. Commercial transport of live animals will only be undertaken where the authorisations, welfare conditions and documentation required for that journey are in place. Cross-border movements may require additional animal-health, veterinary, movement, import/export or CITES documentation.
7.6. We may postpone or refuse a live-animal handover where weather, animal condition, transport conditions, customer readiness, legal requirements or another genuine welfare concern makes the planned handover unsafe or unlawful. Where the order cannot lawfully or reasonably proceed, we will discuss an alternative arrangement or refund as appropriate without limiting your statutory rights.
8. Live animal delivery times
8.1. Live animal delivery is arranged differently from standard courier delivery. Routes may be planned around animal welfare, location, weather, driver availability and grouped delivery runs.
8.2. The livestock delivery vehicle generally operates on planned routes rather than daily courier schedules. Unless a different delivery date or period is expressly agreed with you, delivery will take place within the period required by applicable consumer law. Where a delivery is expected to take longer than the normal statutory period, a later delivery date or delivery window will be agreed with you.
8.3. After an order is accepted, we will provide or confirm the expected delivery or collection arrangement as soon as reasonably practicable. Final timing may sometimes be confirmed closer to the planned livestock route.
8.4. You must make reasonable arrangements to be available for the agreed handover. If you cannot attend, contact us as soon as possible. A missed handover may require a new delivery arrangement and may result in an additional delivery charge only where that charge is lawful, reasonable and communicated to you before you agree to it.
9. Delivery and collection
9.1. Delivery methods depend on the products ordered. Standard products may be sent by courier where available. Live animals, frozen food and live food may require separate delivery or collection arrangements.
9.2. Delivery restrictions and available payment methods will be displayed at or before the beginning of the ordering process where required. Delivery charges will be shown before the order is placed where they can reasonably be calculated in advance.
9.3. If standard products are ordered with a live animal, the products may be delivered with the animal if this is agreed and suitable. If separate delivery is required, any additional cost must be disclosed and agreed before you are bound to pay it.
9.4. Collection is by appointment only. Please do not attend for collection until a date, time and collection location have been expressly agreed. The business address listed in these Terms is not a public collection point.
9.5. Goods remain at our risk until you, or a person nominated by you, acquire physical possession of them, except where applicable law provides otherwise, including where you independently commission a carrier that was not proposed by us.
9.6. Delivery to Northern Ireland or another destination outside the Republic of Ireland is subject to applicable cross-border, customs, veterinary, animal-health, transport and movement requirements. We may restrict a destination where supply or transport would be unlawful or required documentation cannot be obtained.
10. Frozen food and live food
10.1. Frozen food and live food are temperature-sensitive, perishable or otherwise sensitive products and must be handled and stored appropriately.
10.2. West Cork Reptiles does not accept voluntary change-of-mind returns or exchanges of frozen food after delivery or collection. Once frozen food has left our control, we cannot verify that the required storage temperature and handling conditions have been maintained.
10.3. Frozen food is supplied in single-use packaging intended for hygienic transport and storage. Once supplied to a customer, the packaging and contents cannot be safely reused or returned to stock for resale.
10.4. Where the statutory exception for goods liable to deteriorate or expire rapidly applies, frozen food and other qualifying perishable products are not covered by the standard online cancellation right.
10.5. Live food may also fall within this exception where it is liable to deteriorate or expire rapidly.
10.6. This does not affect your statutory rights where goods are faulty, damaged, incorrectly supplied, not as described or otherwise not in conformity with the contract.
11. Standard products
11.1. Standard products include equipment, housing, lighting, heating, bedding, decor, supplements and other reptile supplies that are not subject to a specific statutory cancellation exception.
11.2. Please check product dimensions, compatibility, wattage, fitting, species suitability and other relevant information before ordering. If you tell us that you require a product for a particular purpose and we accept that requirement, your statutory rights relating to conformity with the contract are not affected by this section.
12. Online cancellation rights
12.1. For most goods bought online by a consumer, you have a statutory right to cancel the contract without giving a reason within 14 days. For a typical single delivery of goods, the 14-day period begins when you, or a person nominated by you other than the carrier, acquires physical possession of the goods. Different starting rules may apply to orders delivered in multiple lots or regular deliveries.
12.2. To cancel, you must inform West Cork Reptiles before the cancellation period expires. A clear statement by email or another durable written method is sufficient.
12.3. If the cancellation right applies, you must return the goods without undue delay and no later than 14 days after informing us that you are cancelling, unless we have agreed to collect them.
12.4. Unless we have agreed to bear the return cost, you are responsible for the direct cost of returning goods where we informed you of that responsibility before the contract was concluded. Please contact us before returning goods so that we can provide the correct return address and safe return instructions. This contact requirement does not remove or shorten your statutory cancellation period.
12.5. For goods which, by their nature, cannot normally be returned by post, the direct return cost or a reasonable maximum estimate of that cost will be provided before the order is placed where required by law.
12.6. Where a valid statutory cancellation is exercised, we will reimburse payments due to you, including the cost of the least expensive standard delivery option offered for the original order. We may withhold reimbursement until we receive the returned goods or you provide evidence that they have been sent back, whichever occurs first, unless we offered to collect them. Refunds will be made using the original payment method unless you expressly agree otherwise and will be processed within the time required by law.
12.7. You are responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, where the law permits such a deduction.
12.8. The statutory right to cancel does not apply where a statutory exception applies. Examples include certain goods made to an individual choice or clearly personalised, goods liable to deteriorate or expire rapidly, and certain sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed. Any relevant exception will be identified before purchase where applicable.
12.9. West Cork Reptiles does not offer voluntary change-of-mind returns or exchanges for live animals after delivery or collection. This policy is based on animal welfare and biosecurity considerations.
12.10. Once a live animal has left our care, its husbandry conditions, handling, transport conditions and exposure to other animals are outside our control. Accepting an animal back may therefore create health and biosecurity risks for that animal and for other animals in our care, including the potential transmission of disease or parasites.
12.11. Repeated transport, handling and changes of environment may also cause unnecessary stress to a live animal. Customers should therefore carefully consider the commitment involved and ensure that suitable housing, heating, lighting, environmental conditions and care arrangements are in place before purchasing a live animal.
12.12. If you have a concern about the health, condition or welfare of a live animal at or after handover, please contact West Cork Reptiles as soon as possible so that the matter can be assessed appropriately. We may reasonably request relevant photographs, video, husbandry information or veterinary information where this is helpful to assess the issue.
12.13. Live animals must not be sent to West Cork Reptiles through ordinary postal or parcel courier services. Where an animal needs to be moved in connection with a statutory consumer remedy or another arrangement expressly agreed with West Cork Reptiles, appropriate welfare, biosecurity, handling and transport arrangements must be made in advance.
12.14. Nothing in this section excludes or restricts any statutory consumer right or remedy that cannot lawfully be excluded or restricted.
12.15. Further information about cancellations, returns and refunds is available in our Refund & Returns Policy.
13. Faulty, damaged or incorrectly supplied goods
13.1. Goods supplied to consumers must conform to the sales contract and applicable consumer law. Nothing in these Terms limits your statutory remedies where goods are faulty, damaged, not as described, not of the agreed quality, not fit for an agreed purpose or otherwise not in conformity with the contract.
13.2. Depending on the circumstances and applicable law, statutory remedies may include termination of the contract, repair, replacement or a price reduction.
13.3. If you receive a damaged, faulty or incorrect product, contact us as soon as reasonably possible with the order details and, where helpful, photographs or video. We will assess the matter and provide the remedy required by law.
13.4. Any commercial manufacturer warranty is additional to, and does not replace or reduce, your statutory consumer rights.
14. Animal welfare concerns after delivery or collection
14.1. If you have a concern about the health, condition or welfare of a live animal following delivery or collection, contact West Cork Reptiles as soon as possible and provide relevant details, photographs or video where reasonably helpful.
14.2. If urgent or clinical advice is required, contact a suitably qualified reptile-experienced veterinary professional immediately. Do not delay necessary veterinary treatment while waiting for a response from us.
14.3. We may consider relevant evidence such as the animal's condition at handover, transport circumstances, veterinary evidence and husbandry conditions when assessing what has occurred. This does not remove or restrict any statutory consumer right or remedy that applies.
15. Accounts and security
15.1. You may create a customer account on this website. You are responsible for keeping your login details secure and for ensuring that information in your account is accurate.
15.2. If you believe your account has been accessed without permission, contact us as soon as possible.
15.3. We may suspend or restrict an account where we reasonably believe it is being used fraudulently, to interfere with the website, to misuse promotions or otherwise in breach of these Terms. Account restrictions will not remove any existing statutory rights relating to completed purchases.
16. Promotions, discount codes, vouchers and gift cards
16.1. From time to time, West Cork Reptiles may offer promotional discounts, discount codes, promotional vouchers or other special offers. Promotions may be subject to conditions including eligibility requirements, promotional periods or expiry dates, minimum order values, product or category restrictions, geographical restrictions, usage limits or a maximum number of redemptions. Material conditions will be communicated with the promotion or made reasonably available before the customer relies on the offer.
16.2. Unless a promotion states otherwise, promotional codes have no cash value, cannot be applied retrospectively to a completed order and cannot be combined with another promotional code in the same order.
16.3. A promotional offer may cease to be available when its stated promotional period ends, when a stated redemption or availability limit has been reached, or when the stated conditions of the promotion are no longer met. Where no fixed end date has been specified, West Cork Reptiles may end a promotion prospectively. Ending a promotion does not remove a discount that has already become part of an accepted order or otherwise affect a customer's statutory rights.
16.4. We may temporarily suspend, correct, amend or withdraw a promotion where reasonably necessary because of a genuine technical or pricing error, suspected fraud, misuse or another circumstance affecting the proper operation of the offer. We will not rely on this clause to remove a consumer right or contractual benefit where doing so would be unlawful.
16.5. If you have been provided with a promotional code but it does not apply at checkout, please contact West Cork Reptiles before completing the order. We can check the status and conditions of the promotion and confirm whether it remains available.
16.6. Paid gift cards and gift vouchers are treated separately from free promotional discount codes. Where the Consumer Protection (Gift Vouchers) Act 2019 applies, any expiry date will comply with the statutory minimum period and required expiry information will be provided on a durable medium. Customers will not be required to redeem the full value in a single transaction, and covered gift vouchers will be handled in accordance with the applicable rules on multiple vouchers, remaining balances and refunds.
17. Privacy and legally required records
17.1. We process personal data to operate the website, manage accounts, process payments and orders, arrange delivery or collection, respond to enquiries, prevent fraud, comply with legal obligations and administer after-sales support.
17.2. For the sale or supply of pet animals, applicable Irish law requires certain transaction and animal records to be maintained. This may include the customer's name and address, date of sale or supply and information about the animal. Where legally required, these records will be retained for the statutory period, including for at least three years where required by the Animal Health and Welfare (Sale or Supply of Pet Animals) Regulations 2019.
17.3. For further information about how personal data is collected, used, retained and protected, please read our Privacy Policy.
18. Liability
18.1. Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot lawfully be excluded for death or personal injury caused by negligence, fraud, or any statutory consumer rights and remedies.
18.2. Subject to the paragraph above, West Cork Reptiles is not responsible for loss or damage caused solely by customer misuse, incorrect installation, use contrary to product instructions, unsuitable husbandry, failure to follow reasonable care instructions, or incorrect storage or handling after the goods or animal have been safely handed over, except to the extent that the law provides otherwise.
18.3. General husbandry information is based on the information reasonably available and does not replace professional veterinary advice. Where you tell us about a specific purpose or requirement and we accept it as part of the contract, nothing in this section limits the statutory obligations arising from that agreement.
19. Events outside our reasonable control
19.1. Events outside our reasonable control, including severe weather, transport disruption, animal-health restrictions, legal or regulatory restrictions, power or communications failures or other exceptional events, may delay or prevent performance.
19.2. Where such an event affects an order, we will contact you where reasonably practicable and take reasonable steps to minimise the effect. This section does not remove any statutory right you may have to cancel, terminate or obtain a refund where the legal conditions for that remedy are met.
20. Changes to these Terms
20.1. We may update these Terms from time to time to reflect changes in our business, products, website, delivery arrangements or legal requirements.
20.2. A change to these Terms will not retrospectively alter an existing consumer contract unless the change is required by law or is expressly agreed with the customer where legally permitted. The version made available before your order was concluded will apply to that order, subject to mandatory law.
21. Governing law and cross-border sales
21.1. These Terms and contracts with West Cork Reptiles are governed by the laws of Ireland, subject to any mandatory consumer protection that applies and cannot lawfully be excluded.
21.2. If we direct sales to consumers in another country, including Northern Ireland, this choice of Irish law does not deprive a consumer of mandatory protections that apply under the law that would otherwise protect that consumer.
21.3. Availability of live animals or other restricted products outside the Republic of Ireland is subject to all applicable animal-health, welfare, transport, customs, import/export, movement and CITES requirements.
22. Complaints and contact
22.1. If you have a question or complaint about an order, delivery, livestock transport, cancellation, return, refund, product or animal-welfare concern, contact West Cork Reptiles using the details below. We will review complaints fairly and within a reasonable time.
22.2. Email: [email protected]
22.3. You remain entitled to use any consumer dispute-resolution or court procedure available to you under applicable law.
